GENERAL TERM & CONDITIONS
These general terms and conditions ("terms" or "the terms") apply when you, as a customer, purchase an item via www.helwit.co.uk or via one of its sub-domains such as helwit.com (hereinafter collectively referred to as the "Website"). Agreements are entered between you as a customer ("you" or "the customer") and HELWIT Ltd, company number 12875046 ("Helwit").

To be able to place an order via the Website, you must be over the age of 18, accept our terms, which you are required to do so when processing your order. By accepting these terms, you agree to comply with the terms and confirm that you have read the information about personal data and agreed to the use of personal data and cookies in accordance with HELWIT´s Privacy Policy.

Once we confirm your order and you receive an order confirmation from us via email, you enter an agreement on purchase between yourself as a customer and HELWIT. We advise you as a customer to save this order confirmation for any future contacts with our customer service.

Persons under the age of 18 may not order on the Website. To order, you need to prove your age. We do this because HELWIT is a product intended for adults only (18 years or older). We verify your age through our payment partner, PayPal. An order made in another person's name (forgery of documents), or in another way that entails that HELWIT risks suffering financial damage, will be reported to legal authorities such as the police. In case the case of suspicion of irregularities or misuse of our ordering function, HELWIT always reserves the right to refuse a purchase.

When you place an order, you will be asked to provide certain personal information, you are responsible for ensuring that the information you fill in is correct and complete. Information regarding the way we process your personal data can be found on our website, in our Privacy Policy. Our contact information and other information can also be found on our website, under Contact Us or at the bottom of our website’s footer.

Prices and payment

When ordering via the website, the prices that apply for each product are the ones seen on-screen. All prices include VAT. You can find the various payment options in connection with you placing your order at checkout. HELWIT has the right to charge you for the order. HELWIT reserves the right to not always offer all payment methods or to change payment methods if the one you have chosen for any reason does not work at the time of purchase.

Discounts and promotions

HELWIT reserves the right to withdraw discounts and promotional offered via the website at any time. Offers on the Website are valid for a limited time and as long as stock lasts.

Complaints

If a product differs from the purchase agreement or does otherwise not correspond to the description provided by HELWIT, you have the right to make a complaint about the product to HELWIT.
In that case, you’re welcome to make a complaint about your product. You can find all information on how to file a complaint here.
The right of complaint only includes faults at delivery (and not faults that for instance occurred due to the product’s expired shelf life or due to normal wear and tear). You need to notify HELWIT about the fault within a reasonable time from when you discovered or should have discovered the fault and at the latest three years after you received the product. HELWIT, therefore, recommends you to carefully inspect products directly upon receiving them.
Depending on the type of product fault (e.g., smell/taste of the product) we may require you to return the product to us. You are responsible for the products you return. HELWIT, therefore, recommends that you package the product in a way that doesn’t risk damages during transportation. The product should, if possible, be returned unused and in its undamaged original packaging (e.g., do not write, tape, or put stamps on the original packaging).
Depending on the extent of the damage, you will be able to get a replacement, remediation, or a price reduction. As a last resort, you may be able to return the product. In case of an approved return, HELWIT will compensate you for the costs of the product, except for costs incurring due to return shipment without using the return slip. For further claims, exceeding the costs of the product, HELWIT will act in accordance with UK consumer law.
The following information must be provided:
- The e-mail address at which the purchase was registered
- Order number
- The name of the item you want to return
- Reason for return

Once the product in question has been returned and the complaint has been approved, HELWIT will compensate you under current consumer protection legislation. HELWIT reserves the right to refuse a complaint if it turns out that the product is not defective under current consumer protection legislation. Defective goods returned to HELWIT should be treated as if they were defective. In all types of returns, the product must be packaged in such a way that it does not risk being damaged.

HELWIT is always responsible for return shipping in the case of damaged or incorrect goods, i.e., for approved complaints. When the item in question has been returned and HELWIT has approved the complaint, the customer is compensated. However, HELWIT’s liability is limited to the value of the goods and any return costs. If the customer has already paid for the goods, provided that the parties do not agree otherwise, a refund will be made to the account that was debited at the time of purchase. Refunds are normally made within 14 days.

HELWIT reserves the right to refuse a complaint if it turns out that the product is not defective in accordance with current consumer protection legislation. In cases where errors cannot be proven, a fee of GBP 29 incl. VAT for costs is attributable to HELWIT´s administration, shipping, return shipping and handling of the case. Shipments that do not have a return number are returned to the sender and the shipping cost is charged. The fee is invoiced with payment terms of 10 days net. In the event of late payment, a reminder fee and default interest is paid.

Return

When you as a consumer shop for goods on the internet, you usually have a 14-day right of withdrawal, according to the law on distance contracts and contracts outside business premises. However, the right of withdrawal does not apply to the purchase of products on helwit.co.uk, as all these products are fresh products with a limited shelf life.

Force majeure

HELWIT is not responsible for delays caused by circumstances that HELWIT has not been able to control or is otherwise beyond HELWIT’s control. This can be, for example, strikes, extreme weather conditions, terrorist attacks, and extensive technical problems such as faults in electricity/telecommunications/data connections or other communication beyond HELWIT ´s control.

Products

Some products may only be available through our e-commerce site. These products may have limited quantities and are only subject to return or exchange per our return policy.

We have done everything to show our products in a realistic way as far as we deem possible when it comes to the colours and images of our products on the Website. However, we cannot guarantee that your monitor will reproduce the colours correctly.

We reserve the right but are not obligated, to limit the sale of our products to any person, geographical region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of products we offer. All product descriptions and product prices are subject to change at any time without notice. We reserve the right to remove products from our range at any time.

We always aim to provide the best quality possible, however, we do not guarantee that the quality of the products or the information received by you will be in accordance with your subjective interpretations and wishes.

Errors, inaccuracies and omissions

HELWIT further reserves the right to make typing errors on the Website, such as incorrectly stated prices or incorrect information about stock balances. If an incorrect price has been stated for an item that you have ordered, HELWIT will contact you to agree with you on how we will proceed with the order.

We undertake no obligation to update, change or clarify information regarding third-party websites, except as required by law.

Other

HELWIT reserves the right in individual cases to refuse or change your order, which may occur, for example, if you have payment remarks or have provided incorrect personal information or information in connection with your order.

The Website, including all of its content, is owned by HELWIT or its licensors and affiliates. Material on the Website is thus protected by, among other things, intellectual property law and market law. This means that images, graphics, design, and layout, as well as information about goods, services, and other content, may not be copied or used without HELWIT’s approval. HELWIT is not responsible for information on the website that comes from third parties.

Changes to the terms

HELWIT reserves the right to make changes to these terms. Such changes will be published on the website. Changes may apply from the time you have accepted the terms (in connection with a new purchase or when visiting the website). HELWIT recommends that you stay updated on the website regularly to be notified of any changes to these terms. Your continued use of the website after any changes have been made means that they are accepted.

Invalidity

Should a competent court, authority or arbitral tribunal find that any provision of these Terms is invalid or unenforceable, such provision and all other provisions shall be enforceable to the extent permitted by applicable law. The provisions declared invalid or unenforceable will be replaced by relevant legal guidelines and advice.

Applicable law and dispute

Disputes should primarily be resolved by agreement after discussion with HELWIT´s customer service.
If a dispute cannot be resolved in agreement with HELWIT’s customer service, you as a customer can turn to www.gov.uk, which you can find more information.
